Can an employer dismiss an employee because of illness?

Only in narrow cases. Illness itself is not the ground: the question is whether the employee's capacity to work has changed so substantially that they can no longer cope with their duties.

Since 1 January 2026 the Employment Contracts Act states this ground in chapter 7, section 2, subsection 1, point 2. Before dismissing, the employer must hear the employee and examine whether reassignment to other work would avoid the dismissal (subsection 3).¹

The Supreme Court held in KKO:2006:104 that a substantial and long-term reduction in working capacity caused by illness can be a ground for dismissal. That decision applied the wording in force before 2026.²
